By accessing or using Check In, you confirm that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Check In grants you a nontransferable license to use the App on any Apple-branded products that you own or control and as permitted by the App Store Usage Rules. The terms of this agreement govern any content, materials, or services accessible from or purchased within the App, as well as upgrades that replace or supplement the original App.

Except as provided in the App Store Usage Rules, you may not distribute or make the App available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense the App. If you sell your Apple Device to a third party, you must remove the App from the device before doing so.

You may not copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open sourced components included with the App).

Check In is a relationship management tool designed to help you maintain connections with friends, family, and professional contacts. The App provides features such as contact organization, reminder scheduling, interaction logging, and AI-assisted messaging suggestions ("Chex AI"). We provide the Services on an "as is" and "as available" basis.

You agree that we may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you (if any) related to the Licensed Application. We may use this information, as long as it is in a form that does not personally identify you, to improve our products or to provide services or technologies to you.

To access certain features of the App, you may be required to register for an account using Apple Sign In. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Check In offers a tiered service model. By selecting a paid service, you agree to pay the fees indicated.

You agree not to use the App to:

• Violate any laws or regulations.
• Infringe the rights of any third party, including intellectual property, privacy, or publicity rights.
• Harass, bully, or intimidate others.
• Transmit any viruses, malware, or other malicious code.
• Interfere with or disrupt the operation of the App.

The App and its original content, features, and functionality are owned by Check In and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You retain all rights to any data, information, or content you submit to the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content solely for the purpose of providing and improving the App.

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the terms of the Privacy Policy.

The App may enable access to third-party services and websites (collectively and individually, "External Services"). Use of External Services is at your sole risk. We are not responsible for the content or accuracy of any third-party External Services.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND.

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION.

You agree to indemnify, defend, and hold harmless Check In and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, fees (including reasonable attorneys' fees and costs) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms.

The license is effective until terminated by you or us. Your rights under this license will terminate automatically without notice from us if you fail to comply with any term(s) of this license. Upon termination of the license, you shall cease all use of the Licensed Application and destroy all copies, full or partial, of the Licensed Application.

You may not use or otherwise export or re-export the App except as authorized by United States law and the laws of the jurisdiction in which the App was obtained. In particular, but without limitation, the App may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List.

The Licensed Application and related documentation are "Commercial Items", as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation", as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

These Terms and the relationship between you and Check In shall be governed by the laws of the State of California, excluding its conflicts of law provisions. You and Check In agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California, to resolve any dispute or claim arising from these Terms.

If (a) you are not a U.S. citizen; (b) you do not reside in the U.S.; (c) you are not accessing the Service from the U.S.; and (d) you are a citizen of one of the countries included in the European Union, Switzerland, Norway or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.
